MEMORANDUM OF AGREEMENT
between
UNION PACIFIC RAILROAD COMPANY – EASTERN DISTRICT
and
UNITED TRANSPORTATION UNION (C&T)
MODIFICATION OF SECTION 6(1) OF THE SENIORITY
ZONE 200 AGREEMENT AND SECTION 6(4) AND 6(5) ADDED
IT IS AGREED that Section 6(1) of the Seniority Zone
200 Agreement is modified as follows:
“(6)(1) Any employe moving under the provisions of Section 6 hereof will not be permitted to move again under those provisions for a period of 120 days unless he/she is a senior applicant for a regular assignment on another prior seniority district, or the provisions of Section 6(4) are applicable.”
It is further agreed that Section 6(4) and 6(5) be added as follows:
“(6)(4) When an employe is forced or exercises his/her road rights to transfer to another prior road seniority district under Seniority Zone 200 due to being furloughed as a road employe at their home point, he/she may return to their home point, seniority permitting, on increase of the road extra board. If the employe fails to return to the home point at the first opportunity, he/she will be required to remain at the point to which transferred for a period of 120 days unless he/she is the senior applicant for a bulletined assignment on another prior seniority district.”
“(6) (5) Employes working in road service on one prior seniority district in. Seniority Zone 200 may exercise seniority to road service on another prior seniority district in Seniority Zone 200 on the conditions that:
Such transfer shall be made effective as soon as possible, but in no event later than seventeen (17) days from the date of application and/or from when the brakeman’s extra board is increased. Roadmen not so handled will be granted a special allowance equal to the earnings which they would have received had they been transferred for each calendar day held after the expiration of the 17-day period (including layover days) , providing the employe is available for service on such calendar days, which shall be in addition to all compensation for actual service performed.”
“This Agreement is effective August 1, 1989, and shall continue in effect thereafter subject to the provisions of the Railway Labor Act, as amended.”

Dear Sir:
This is in reference to employes exercising their conductors’ seniority under the Zone 200 Seniority Agreement.
It is agreed that an employe exercising their seniority under the Zone 200 Agreement will not be permitted to work as Conductor until after 60 calendar days on the new territory. After 60 days, such employe can exercise seniority on a Conductor’s vacancy or can be force assigned as Conductor.
This agreement is effective November 22 __, 1988 and may be cancelled by either party by serving a10-day written notice of intent to cancel.

In the negotiations which lead to the ratification of the Seniority Zone 200 Agreement dated Setpember 21, 1988, questions arose concerning the application of Section 5(2) of the agreement as it pertained to the employees’ obligation to protect their conductor’s seniority.
It was understood that the intent of Section 5(2) would not modify Section 9 of the Dual Rights Agreement, and employees working in yard service will be required to protect their conductor’s seniority as provided for under the provisions of Item 92(a-5) of the current Road Schedule of Rules.

In our negotiations leading up the the ratification of the Memorandum of Agreement dated September 27, 1989, modifying the Seniority Zone 200 Agreement, it was understood that it was the intent of Section (6)(4) that an employee must have an application to return to his “home point” on file with CMS prior to the extra board being increased at the “home point.”
If the extra board is increased sufficiently to permit the employee to return to his “home point,” and the employee does not have an application on file with CMS to return, that employee will then be required to remain at the location to which transferred unless he is the senior applicant for a bulletined assignment on another prior road seniority district, or transfers
to yard service under the provisions of Sections 5(a) and (b) of the Dual Rights Agreement.
If an employee has filed an application with CMS but subsequently decides not to transfer, he must withdraw the application before he is notified by CMS that he is being transferred, or he will be required to transfer.

In the application of Section 6(1), an employee in road service who exercises his Zone 200 seniority rights under the provisions of Section 5(3) and bids on a bulletined road assignment on another prior road seniority district, and then voluntarily relinquishes the assignment, will be governed by the Schedule Rules in effect on the “home district” of the assignment, and will displace in accordance with the provisions of Schedule Rule 92(15). The employee will be required to remain on the prior road seniority district of the assignment for a period of 120 days from the date he was assigned unless he is the senior applicant for a bulletined assignment on another prior road seniority district, or transfers to yard service under the provisions of Sections 5(a) and (b) of the Dual Rights Agreement.

In the negotiations which led to the ratification of the Seniority Zone 200 Agreement dated September 21, 1988, and the Memorandum of Agreement dated September 27, 1989, which modified Section 6(1) and added Sections 6(4) and (5) to that agreement, questions arose regarding obligations and rights of employees in the application of Section 6(1) as it pertains to the employee who exercises his Zone 200 seniority rights under the provisions of Section 5(3), and is subsequently displaced from the assigned run which has been in effect less than 90 days. It was understood that the following would apply:
An employee displaced from an assigned run that has been in effect for less than 90 days will be governed by the Schedule Rules in effect on the “home district” of the assignment and will be subject to the provisions of Schedule Rule 92(18).
If unable to return to the former assignment, crew, or position, the employee may exercise seniority, but will be required to remain on the prior road seniority district of the assignment for a period of 120 days from the date he was assigned unless he is the senior applicant for a bulletined assignment on another prior road seniority district or transfers to yard service under the provisions of Sections 5(a) and (b) of the Dual Rights Agreement.
