Dear Sir:
This is to confirm our various discussions concerning Section 11 of
the Agreement of September 17, 1976, and the various time claims concerning
whether that section applies to other than pool crews operating from terminal
to terminal.
Section 11 reads in pertinent part:
"In consideration of this, the following will apply to
7th and 8th District trainmen:
'Paragraph (a) of Part III "Rule Changes" of
the UTU(C)&(T) Interdivisional Runs Agreement
dated May 22, 1972, modifying paragraph (a) of
Rule 29 "Overtime" of the Rules Agreement.'"
It is your position that because Section 11 does not restrict its
application to pool crews, it would apply to short turnaround service.
It is the Carrier's position that the modification to Rule 29 in the
Interdivisional Runs Agreement only applied to employees in the Inter-
divisional pool and, therefore, would only have application to pool crews
operating terminal to terminal in the same manner as Interdivisional
crews.
It was agreed that Section 11 of the Establishment of 13th Seniority
District Agreement dated September 17, 1976, would be applied to short
turnaround service. It further was agreed that claims presently pending
would be allowed.
In consideration of the above settlement, it was agreed that Section
1 of the Agreement of September 17, 1976, would be amended as follows:
"Thirteenth Seniority District: East switch Black
Buttes, to and including West Switch Granger, and all
yards and branches within this territory."
Additionally, it is agreed that 8th District employees, working in
pool freight service, will not be used east of the east switch at Point
of Rocks.
