RULE 93. VACANCIES. (a) Vacancies occurring as a result of engineers resigning, retiring, being dismissed from the service, or being off the run to which assigned for a period longer than 15 days, will be bulletined.

NOTE: Vacancies covered by this rule which result from authorized leaves of absence longer than 15 days must be bulletined at the commencement of the leave.

(b) Extra Engineers. At points where extra lists are maintained, extra engineers will run first-in, first-out in filling vacancies except as provided in Rules 12, 13, and 100.

(e) Extra Engineers Laying Off Or Missing A Call At Home Terminal. An extra engineer who is . permitted to lay off prior to or at calling time will not be permitted to report for service until after the expiration of 16 hours from time he is authorized to lay off and must call after the expiration of the authorized leave and report for service. The extra engineer laying off on call or missing a call will be placed on the board behind the engineer who accepted the call providing that the engineer does not return to the terminal before the expiration of 16 hours.

NOTE: The 16-hour requirement specified above will not apply to a Local Chairman of the BLE who is required to lay off for Organization work while working on the engineer extra board. In such cases the Local Chairman will be placed at: the foot of the extra board upon furnishing advice that he is available for service.

AGREEMENT

between UNION PACIFIC RAILROAD COMPANY-EASTERN DISTRICT

and BROTHERHOOD OF LOCOMOTIVE ENGINEERS

MODIFICATION OF BLE RULE 93 (a)

Effective November 1, 1984, Rule 93 (a) of the BLE Schedule dated December 1, 1979, is modified for the Eastern District as follows:

"When the BLE local chairman furnishes advice to CMS that a job or turn should be bulletined or filled by application as a result of an engineer securing a leave of absence, such advice from the local chairman will determine the commencement of the leave.

"No claims will be progressed as a result of this interpretation.

fflf CMS is not advised to the contrary by the appropriate local chairman, the job or turn will be bulletined (or filled by application) after the 15th day per Rule 93(a).11

This Agreement is effective November 1, 1984, and shall automatically terminate ten (10) days from the date of written notice by either party.
